Report on the legal implementation of the EU ETS at Member State level

The ENTRACTE research project is aiming to analyse the European climate policy portfolio with special emphasis on the role of interactions between its different parts. The project’s ultimate goal is to provide pragmatic guidance to policy makers for designing effective, cost efficient and politically and legally feasible climate policy portfolios.

In this report an ex-post evaluation of the legal implementation of The European Union Emissions Trading Scheme (EU ETS) at Member State level is carried out. The EU ETS legislation originally left a considerable amount of discretion to Member States. The research is mainly focussed on the implementation of the provisions aimed at enhancing compliance (monitoring, verification and enforcement) without losing sight of the broader functioning of the ETS.
